The Sindh High Court’s Sukkur Bench has directed private schools across the province to provide free education to at least 10 percent of underprivileged and deserving students, warning that schools failing to comply risk having their registrations suspended.
In a written verdict, the SHC made it clear that every private school must enroll poor students in accordance with its total enrollment numbers. The decision came from a constitutional bench comprising Justice Zulfiqar Ali Sangi and Justice Riazat Ali Sahar, who expressed strong dissatisfaction with the lack of compliance from private schools regarding previous court orders.
The court has instructed the Director of Private Schools to submit a detailed report on the status and compliance of all private schools in Sindh within three months. Justice Zulfiqar Ali Sangi noted that Article 25-A of Pakistan’s Constitution requires the state to ensure free education for all children aged 5 to 16 years.
The SHC has adjourned further proceedings until November 10.
This development comes as courts in other parts of Pakistan also examine the legal obligation for private schools to allocate 10 percent of admissions to students from underprivileged backgrounds. Last month, the Islamabad High Court issued similar directives for the federal capital, instructing private schools to report on their implementation of this rule.
Under the Right to Free and Compulsory Education Act, 2012, private educational institutions in Pakistan are legally required to provide free education to at least 10 percent of their enrolled students who are from underprivileged backgrounds. Courts have ordered relevant regulatory authorities to collect and submit comprehensive data to ensure the law is being enforced.
